Illegal To Remove PJ Mayor, Say MBPJ Councillors

aNt's aNgle

WHAT A DAY today turned out to be.

I got an emergency message on my mobile phone and next thing I knew I was at an emergency meeting in MBPJ at 4pm.

Luckily my best pal Andrew Martin was able to rush over and help me dress up in time for the meeting.

Councillors in rapt attention
The sudden removal of our beloved mayor Dato Roslan bin Sakiman was a shock to us. No one more, probably, than I as Roslan has been a strong supporter for disabled and animal issues.

Here is a statement that the councillors put out:

Derek Fernandez reads out the press statement
PRESS STATEMENT: The directive, decision or instruction by the public sevices board to transfer is illegal and ultra vires the local goverment act 1976. The power to appoint the mayor is a statutory power vested exclusively in the state authority. No such power is given to the public services board and any attempt to transfer the mayor by the PSB is a direct usurpation of  s10 of the local goverment act 1976. Only the state authority can remove, transfer or appoint the mayor. Once the mayor swears his oath he ceases to be  a mere civil servant. Action must be taken against the PSB for abuse of power. Futhermore what rubbish to send a letter dated 27 Sept 2012, received by the mayor on 28 Sept 2012, to leave 1st Oct 2012.

It shows poor management and no respect by the local authority, people of PJ, and the councillors who were not informed at all.

The PSB has overstepped its role and should not interfere in the local government.

Datuk Roslan was well liked and just launched a people friendly budget. The council has decided that he report for duty immediately and not follow illegal instructions. The mayor is duty bound not to follow illegal instructions."
